- Immediate Impact:
- Louisiana
- Trigger ban immediately outlawing all abortions via SB 342 (2022). Pregnancy is protected at the moment of fertilization.
- Abortion clinics will be forced to close immediately
- Individuals will not be able to receive medication abortion pills from Louisiana doctors and face potential fines for receiving medication abortion pills from out of state clinics and doctors starting August 1.
- On June 27, 2022, an injunction was filed to prevent the trigger ban from going into effect. As of June 27 and at least until the first hearing on July 8th, abortions may proceed in Louisiana.
- On July 8, 2022, a judge determined the case filed seeking to clarify which trigger ban was controlling in Louisiana, should have been filed in Baton Rouge. The judge declined to extend the injunction, which immediately outlawed abortion in Louisiana.
- On July 12, 2022, a judge
- Trigger ban immediately outlawing all abortions via SB 342 (2022). Pregnancy is protected at the moment of fertilization.
- Texas
- Trigger ban outlawing all abortions 30 days after a decision to overturn Roe. Texas House bill 1280, would make it a second-degree felony “for a person who knowingly performs, induces, or attempts an abortion” according to the bill analysis. The penalty would increase to a first-degree infraction “if the unborn child dies as a result of the offense.”
- The legislation makes no exceptions for rape or incest; the only exception is if a pregnancy would kill the pregnant person or severely injure them.
- Abortion clincis will likely continue to operate through the 30 days
- Mississippi
- Trigger ban outlawing all abortions has been on the books since 2007. The trigger ban has a requirement of certification from the governor that must be completed within 10 days of the decision to overturn Roe.
- There are two exceptions in that law: rape when there’s a formal charge and protection of the life of the mother.
- Clinics will likely operate on a touch and go basis until official certification.
- Trigger ban outlawing all abortions has been on the books since 2007. The trigger ban has a requirement of certification from the governor that must be completed within 10 days of the decision to overturn Roe.
- Louisiana
The Supreme Court overrule Roe v. Wade, which provided abortion protections nationwide. Abortion (procedural or medication) is not legal in Louisiana.
